24. Product Liability,

24. Product Liability, Warnings: Warning Indicates a possible dangerous situation, which may lead to death or serious injury if it is not avoided. Risk of injury by catching body parts in an opening between frame and leaf/sash. Never reach between the leaf/sash and the frame when closing windows and doors and always use caution. Keep children and persons incapable of assessing risks away from dangerous areas. We especially warn against injuries like contusions if body parts are in the area of the rabbet when powered windows and motor-driven doors, depending on their location, are in the process of closing If necessary, the client is responsible for creating respective suitable safety measures in order to prevent this (e.g. contusion ledges, acoustic and/or visual signals, arrangement and/or type of switch, ...). Risk of injury by falling out of open windows/doors, etc. Proceed with caution around open windows and doors. Keep children and persons incapable of assessing dangers from accessing the danger zone. Risk of injury and material damages by pressing the leaf/sash against the edge of the opening (embrasure). Avoid pressing the leaf/ sash against the edge of the opening (embrasure) and/or apply suitable safeguards (door stop). Risk of injury and material damages by inserting obstacles in to the opening gap between the sashes and the frame. By inserting obstructing material falsely (e.g. wedges) to affect the closing function of the windows, the window itself or the fittings may be damaged.. Risk of injury and material damages through additional stress on the sash. Refrain from adding additional stress on sashes. Prevent risk of injury and material damages through the effects of wind on open and tilted windows. Close and properly arrest sashes when a strong wind or draft are present. Risk of injury and material damages through uncontrolled closing and opening of the sash. Ensure that the sash is slowly directed by hand throughout the entire range of motion, from the absolute opening to the closing position. Open and tilted windows do not fulfill any requirements in regard to joint tightness, driving rain resistance, sound absorption, insulation and burglary protection. Based on the manufacturing process, sharp edges and pointed corners cannot be avoided. Especially for open sashes and/or for blank cut surfaces of aluminium profiles (e.g. bevels of aluminium frames and or cut surfaces of solar protection guide rails etc.) there is a risk of injury due to the formation of sharp burrs. All users (residents, cleaning staff, …) must be informed in this regard to ensure that these danger zones are treated with special care and caution and injuries do not occur! Any individuals incapable of assessing dangers (children, etc.) must be kept out of the vicinity of these danger zones! Please beware that KATZBECK does not conduct any plausibility testing on regard to conformity with respective building regulations, OIB guidelines, standards and other directives. The client is acting upon his own authority. Fittings relevant to safety must be checked for tightness and wear on a regular basis. If necessary, retaining screws have to be tightened and/or components exchanged. All windows and doors intended for the purpose of opening, closing and locking have to operated at least once a month in order to prevent any damages through “stationary wear” (especially corrosion or sluggishness). 44 KATZBECK-MANUAL

When remounting opening sashes and leafs, make sure that any parts of fittings relevant to safety are properly arrested and/or fixed. Especially for hidden fittings beware that all bolts (incl. any turn and opening stops) are properly arrested. The leaf of heavy doors has to be secured against hitting the embrasure through a doorstop the client has to install. Otherwise damages may result based on the enormous forces acting on the hinges. Any assembly and service work may only be performed by authorized certified professionals. Especially safety components, such as doorstops, arrester and cleaning cross shafts, may only be unlocked by certified professionals for the purpose of adjusting the leaf and/or to remount or unhinge the leaf. Electrical components such as electric door openers, electric skylight openers, motors for blinds and shades along with the respective controls, may only be commissioned authorized professionals (licensed electrician). We expressly indicate that there may NEVER be any persons in the direct vicinity of the danger zone for automated drives of opening sashes during the opening and closing motions, in order to prevent any contusions and ensuing issues! If the sash is operated via an automated system for opening and closing, the operator must be able to see the moving components at all times during the cycle and, furthermore, has to manually interrupt the process in order to prevent injury. Any and all persons dealing with the opening and closing cycles must be informed in this regard! Float glass does not fulfill any increased or hazard-free danger of breakage, burglary stop or fire safety. Please beware of local construction regulations, guidelines, standards and directives. The client is responsible for using the right glass. KATZBECK DOES NOT conduct any plausibility checks in this regard. Float glass breaks easily. The ensuing sharp-edged shards present the risk of injury. Various types of glass (float, ESG, VSG…) and glass structures (double, triple) and/or coats (insulation, sun block) can create varying color impressions and/or reflections of light. This does not constitute grounds for any claims. Formation of condensation on the inside and the outside of glass surfaces does not constitute grounds for any claims. Glazing delivered separately must be stored out of direct sunlight. Moisture may damage the edge compound. Direct sunlight may cause excessive overheating of glazing and even breakage of the glass. Increased thermal stress and heat buildup on the glass may lead to spontaneous breakage of glass. Therefore, please refrain from partially protecting the glass from sunlight, which may occur by e.g. partially covering it up or by using internal sun protection or blinds. Heat buildup may also occur through external heat sources (radiators, lighting) and through sunlight, which is increased by dark objects in direct vicinity of the glass. Avoid applying film and color on the glass, subsequently. In very few individual cases, toughened safety glass (ESG) may have a tendency of spontaneously breaking, due to nickel sulfide inclusions. By applying the so-called Heat-Soak Test the risk of this characteristic appearing can be largely minimized. Therefore we recommend assigning a Heat-Soak Test when using toughened safety glass (ESG). In the event that toughened safety glass (ESG) was installed without having assigned a Heat-Soak Test, spontaneous breaking of the pane shall not be covered by warranty and the customer has to bear the costs incurred by the exchange of a window pane. The Austrian standard (ÖNORM) B 3738 (current version) is in effect for the assessment of any errors in glazing, as agreed. Closed windows will not reach the minimum rates of exchange of air required for health and clean room climate purposes! If our windows are being used for room ventilation, sufficient airing intervals and/or mechanically supported systems have to be ensured. KATZBECK-MANUAL 45
